CONFRONTATION OF STIGMATIZATION OF ENTERPRISING FAILURE

– The closure and bankruptcy of an enterprise are normal occasions not necessarily synonymous with fraud

– In general, the failed businessmen learn from their errors and become better

– The stigmatization deters the failed businessmen from developing their increasing capabilities

– A policy of second chance would be profitable for the economy of the E.U.

The stigmatization is faced with:

  1. The change of mentality: that is to improve the public image via education and media. To emphasise the benefits of a new start through informative campaigns and educational programs. The media can play a significant role in disconnecting the notions of bankruptcy and fraud.
  1. The role of legislation about insolvency. All businessmen, regardless whether they went bankrupted deceitfully or not, should not be treated by the legislations of states members equally. The interests of all parts should, therefore, be properly protected, and the possibility of a new start should be simultaneously accepted. The legislation about bankruptcy should draw an explicit distinction between fraudulent and non fraudulent bankruptcy. All enterprises which do not go broke deceitfully, should take official decision of court that declares them non fraudulent. A timely exemption of the remaining debts based on certain criteria should be foreseen by the legislation about insolvency. Legal restrictions or abstraction of rights should be limited etc.
  1. Active support in the enterprises that are in danger. Viable enterprises should be offered timely and economically accessible support so that the cases of insolvency to be minimised. All the chances of networking, which the E.U and the European organizations of enterprises offer, to be fully utilised. Finally the legislation about insolvency should foresee the possibility of restructuring and rescuing an enterprise instead of focusing only on liquidation.
  1. Active support in those who make a second start. The appropriate authorities should allocate sufficient funds to those who start afresh, and at the same time abolish the barriers and offer the new enterprises access to programs of public financing. The banks and the financier institutions should revise their particularly circumspect attitude toward those who make a second start. The E.U countries  should ensure that enterprises which are not involved in a fraudulent bankruptcy, are not among those who have limited access in banking loans. Finally, those who attempt for a second time, should be offered sufficient psychological and technical support as well as special training.

  • INTERVENTION FOR THE HARMONISATION OF LEGISLATION, SO THAT THE STIGMATIZATION OF ENTERPRISING DISFAVOUR TO BE OBLITERATED THROUGH STIMULATING POLICIES AND BENEFITS WHICH WILL HELP IN ATTAINING A NEW BEGINNING.
  • INVESTIGATION, DISENGAGEMENT AND RE-ESTABLISHMENT OF NATURAL AND LEGAL ENTITIES   FROM DATA THAT CONCENTRATE AND DISPOSE PERSONAL FINANCIAL INFORMATION e.g. ‘TIRESIAS’.
  • NOTIFICATION AND APPLICATION OF METHODS THAT LEAD TO POSSIBLE RESCUE, RECONSTRUCTION, OR DISCONTINUANCE OF AN ENTERPRISE.

① O.Y.D.E. N.G.O DOES NOT ACCEPT FINANCING OR OTHER FORMS OF ECONOMIC BENEFITS FROM THE GOVERNMENT OR ANY OTHER STATE ORGANISATIONS.

② THE OPERATION OF O.Y.D.E. N.G.O IS SUPPORTED EXCLUSIVELY BY MEMBER SUBSCRIPTIONS, FEES FOR THE RENDERING OF SERVICES AND DONATIONS.

③ O.Y.D.E. N.G.O IS COMPOSED OF A FIVE-MEMBER ADMINISTRATIVE COUNCIL IN WHICH REGULAR MEMBERS AND GROUPS OF SPECIAL COLLABORATORS PARTICIPATE.

④ PEOPLE BEING INTERESTED IN BECOMING AID-GIVERS CAN MAKE A WRITTEN DEMAND. EACH MEMBER ACCEPTS THE AIMS AND THE POLICY OF O.Y.D.E. N.G.O IN WRITING AND OFFERS AN ANNUAL SUBSCRIPTION.

⑤ O.Y.D.E. N.G.O PROVIDES ADVISORY SERVICES TO MEMBERS WHO HAVE MADE A RELATIVE DEMAND AND HAVE BROUGHT ALL THE NECESSARY ELEMENTS SO AS TO BE EXAMINED. EACH ADDITIONAL WORK OR SERVICE ON BEHALF OF O.Y.D.E. N.G.O OR OF ANY SPECIAL COLLABORATOR (SUCH AS LAWYERS, ECONOMISTS, etc.) HAS ADDITIONAL PRE AGREED DEBIT – FEE. BEFORE EACH ACT AN AGREEMENT IS MADE OUT AND AFTERWARDS A LEGAL RECEIPT IS ISSUED.
